- Definition and subject of the agreement
This conditions constitutes a legal agreement between Azienda Agricola Reggiana di Ferrari e Coloretti soc. agr. Via E. Zacconi, 22/a-b-6 – 42020 – Albinea (RE) – Italy (Seller) and any user who purchases products from the Site www.aziendagricolareggiana.com (“Site”) (Customer).
Any Purchase Order for products at www.aziendagricolareggiana.com is governed by these Conditions, without prejudice to the Seller’s right to apply different and particular conditions. The applicable Conditions are those in force at the time of placing an Order. Azienda Agricola Reggiana reserves the right to modify these General Conditions of Sale at any time, without prior notice.
These Conditions do not regulate the sale of products or the provision of services by parties other than the Seller, which are present or recalled on the Site through links, banners or other links. In relation to such sales or supply of services, any form of liability of the Seller is therefore excluded.
If the Customer is a consumer (defined as natural person acting for purposes unrelated to professional activity) the Contract is also governed by the rules set out in Italian Legislative Decree 6 September 2005, n. 206 (“Consumer Code”).
- Orders
The Customer undertakes, before proceeding with the confirmation of his Order, to read these Conditions and to accept them by affixing a check (flag) in the indicated box.
By placing an Order through the Site, the Customer guarantees both that he has the ability to act necessary to conclude legally binding contracts, and that he is 18 years old. Customers who place Orders through the Site accept the Terms and Conditions as follows.
The Seller offers its products for sale within the limits of stock available at the time of the Purchase Order. Orders may be subject to quantity limitations, minimum or maximum.
The Customer can only purchase the products in the electronic catalog of the Site at the time of placing the Order, as described in the information sheets.
The information on the products on the Site, such as technical specifications, images, dimensions or compatibility details, are not binding and may be subject to change at any time.
The technical steps for placing an Order are clearly highlighted in the sequence of pages of the Site, through explanatory texts and graphics.
By clicking on “Confirm Order”, the Customer will formulate a contractual purchase proposal concerning the items contained in the Cart. Receipt of the Order does not constitute acceptance of the contractual purchase proposal.
To complete the Order, the following formalities must be completed:
- reading and acceptance of the Customer, through “point and click”, of these Conditions;
- compilation in electronic format by the Customer – by entering all the required data – of the Order Form which contains a summary of the essential characteristics of each product or service chosen and the relative price; the methods of delivery of the purchased products; shipping and delivery times and costs; the conditions for exercising the Customer’s right of withdrawal and for the application of the legal guarantee of conformity; the methods and times for returning the purchased products;
- payment, in favor of the Seller, of the price of the product (s) purchased by the Customer, including shipping and delivery costs;
- automated electronic forwarding, by e-mail, to the Seller of the Order Form;
- electronic receipt by the Seller of the aforementioned Order Form.
- The execution of the Order involves the express acknowledgment by the Customer of the obligation to pay.
- Correct receipt of an Order is confirmed by Azienda Agricola Reggiana by e-mail to the address supplied by the Customer.
The Seller will have the right not to process the Purchase Orders made in accordance with the provisions of the previous provisions, in the event that the Customer has not paid for the products, in the event that the Customer’s data are incomplete and / or incorrect; or even in the event that the ordered products are not, even temporarily, available.
If the Seller does not execute a Purchase Order made by the Customer, the Seller will promptly inform the Customer, by e-mail, of the foregoing and will refund any amount already paid by the Customer..
- Methods of payment
All prices on the site are to be intended as retail prices and, therefore, inclusive of VAT. Azienda Agricola Reggiana reserves the right to change prices at any time, without prior notice.
The price of the products ordered is the one in force on the day the Order is placed and must be paid to the Seller.
Shipping costs are not included in the purchase price, but are indicated and calculated at the time the Order is concluded and before payment is made.
The Customer can pay for the ordered products through one of the payment methods indicated on the Site. In the case of payment by credit card, the purchase amount will be charged to the Customer after the conclusion of the Order on the Site. The related financial information they will be managed exclusively by the payment circuits.
The aforementioned information may be used by the Seller only to complete the procedures relating to the payment of products or services, or to provide for refunds following the exercise, by the Customer, of the right of withdrawal referred to in the following
- Delivery methods
Orders are processed from 9.00 to 17.00, Monday to Friday. Orders placed after 5pm on Friday will be processed the following Monday. Azienda Agricola Reggiana will ship the products purchased by the Customer, by courier, to the address indicated by the same, approximately within 36 working hours from the acceptance of the Order.
Depending on the destination area of the goods, deliveries may take place over a period of time ranging from 36 hours to 72 working hours, except for unforeseen circumstances (in any case no later than thirty days from the date of the order). Azienda Agricola Reggiana assumes no responsibility for inefficiencies attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and inefficiencies of the Internet network, in the event that it fails to execute the Order within the time stipulated in the Contract.
The courier is responsible for the delivery. Azienda Agricola Reggiana undertakes to collect any reports of non-delivery or delayed delivery of the products. Any damage to the packaging and / or products, or the mismatch in the number of packages or indications, must be immediately reported to the courier through specific indication on the delivery document.
By signing the delivery document and in the absence of the aforementioned disputes, the Customer certifies the real material integrity of the products and the conformity of the delivery.
The facts referred to in paragraph 3 of this article must be reported, by e-mail, to the Seller within 7 days of delivery, attaching the invoice (if issued) and the copy, pertaining to the Customer, of the waybill of the courier, as well as adequate photographic documentation.
- Invoicing
The Seller will issue an invoice for each Customer who has requested it and who, for this purpose, has entered their tax code, VAT number in the appropriate Order Form. In this sense, the information as provided by the Customer at the time of the Order is valid.
No invoice can be issued after submitting the Order Form, unless requested at the time the Order is placed.
No modification of the invoice will be possible after it has been issued.
When ordering, it is necessary to indicate whether the shipping address is different from the billing address.
If the customer decides not to enter their tax code or VAT number, Azienda Agricola Reggiana will not issue an invoice, but a receipt.
- Right of withdrawal for the consumer customer in accordance with the Consumer Code
The consumer customer has the right to withdraw from the Contract, without penalty and without expenses, within 14 days of receipt of the Goods with written notice by registered letter with return receipt or email. This article applies only if the customer is a consumer (natural person acting for purposes unrelated to professional activity).
The Customer who intends to withdraw from the Contract must return all the Goods to Azienda Agricola Reggiana, via E. Zacconi, 22 / a-b-6 – 42020 Albinea (RE) within 14 days from the communication of the exercise of the right of withdrawal. The shipping costs are charged to him.
If the goods have been delivered, the substantial integrity of the goods to be returned is an essential condition for exercising the right of withdrawal. The goods must be returned in a normal state of conservation and must have been kept with the use of normal diligence. The goods must be sent to Azienda Agricola Reggiana, via E. Zacconi, 22 / a-b-6 – 42020 Albinea (RE) – ITALY in the packaging with which it was delivered to the Customer, due to the fragility of the goods offered for sale by the seller.
Once the integrity of the returned product has been verified, Azienda Agricola Reggiana will refund the Consumer Customer the full amount paid for the products referred to in the Purchase Agreement subject to withdrawal, no later than 30 (thirty) days from receipt of the products themselves. The refund will be made by bank transfer, in accordance with the correlative instructions and bank details that will be indicated by the same Consumer Customer.
The shipping costs of the goods, in case of exercise of the right of withdrawal, will not be reimbursed in any way by Azienda Agricola Reggiana because they are due by the Customer.
Azienda Agricola Reggiana will only accept returns of goods in perfect condition and in their original packaging, accompanied by the relative transport document or, if missing, by the relative Order acceptance receipt.
- Intellectual Property Rights
All rights on the Site and on all materials contained therein as well as on trademarks and / or distinctive signs and/or on any and all material or content on which intellectual, industrial or any other property rights exist are exclusively owned by Azienda Agricola Reggiana. and / or other subjects and/or its assignors. No rights are attributed to the Customer..
- Protection of minors
Azienda Agricola Reggiana does not sell wine or other alcoholic products to minors under the age of 18. The courier will not deliver wine or other alcoholic products to minors under the age of 18 and may request an identity document to verify the age.
- Complaints

- Applicable law and competent court
The sales contract between the customer and Reggiana Farm is concluded in Italy and governed by Italian law. For the solution of civil and penal disputes deriving from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference forum of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Reggio Emilia Forum.
